Historic PFAS Trial Begins as New Jersey Takes on DuPont

The long-anticipated environmental trial between the New Jersey Department of Environmental Protection (DEP) and chemical giant DuPont officially began yesterday, marking a pivotal moment in the fight against PFAS contamination in New Jersey. Lieberman Blecher & Sinkevich is closely following this landmark case, and partner Stuart Lieberman was in the Camden court room for the opening day. The federal lawsuit centers on DuPont’s alleged responsibility for decades of PFAS pollution—per- and polyfluoroalkyl substances that have wreaked havoc on the environment and public health.

The trial’s first day took an extraordinary turn as the DEP Commissioner provided live testimony—an unprecedented move in DEP litigation. Commissioners rarely testify in such proceedings, underscoring the gravity of the allegations and the stakes for New Jersey residents.

Attorneys at Lieberman Blecher & Sinkevich are monitoring this important case because the firm has and does represent injured persons in PFAS litigation. In fact, the firm was one of plaintiffs’ counsels in the first New Jersey PFAS case filed over a decade ago.

DuPont’s legal team cross-examined the DEP Commissioner, a moment that highlighted the aggressive posture the defense is taking in the face of mounting evidence of widespread PFAS contamination. As environmental lawyers with deep experience in complex toxic torts and regulatory cases, Lieberman Blecher & Sinkevich knows how rare and significant it is for a sitting commissioner to take the stand. This early courtroom drama has already set the tone for what promises to be a historic case in New Jersey’s environmental legal history.

PFAS contamination in New Jersey is not just a legal issue—it’s a public health crisis. These so-called “forever chemicals” do not break down in the environment and have been linked to serious health issues including cancer, hormone disruption, and developmental problems.

Lieberman Blecher & Sinkevich has long advocated for stricter accountability when it comes to industrial pollutants like PFAS in New Jersey, and this trial is a critical step toward achieving justice for communities who have been unknowingly exposed to these dangerous substances.

As the case unfolds, Lieberman Blecher & Sinkevich remains committed to holding polluters accountable and protecting the rights of those persons harmed by PFAS in New Jersey. This trial against DuPont represents not just a battle over liability, but a broader fight for environmental integrity and public trust. The testimony delivered on day one already demonstrates that this is no ordinary case—and Lieberman Blecher & Sinkevich will continue to monitor and support efforts to secure a cleaner, safer New Jersey for future generations and to provide legal representation for persons who have become ill as a result of PFAS exposure from their drinking water.
